Commercial License Agreement – Advertising/Editorial

The Photographer retains all rights, license, copyright, title and ownership of the image.

In purchasing this image you are accepting the terms of this License Agreement.

This License Agreement grants the purchaser a non-exclusive, non-transferable, worldwide license to use the purchased image for the permitted commercial purposes, defined as:

• Advertising, promotion, brochures, packaging, catalogues, annual reports or advertising in magazines and journals;

• Posters and flyers for promotional purposes (not for resale);

• Editorial content in calendars, magazines, books, journals, newspapers & other printed publications;

• Video, broadcast, theatrical.

 

This license is:

• Periodic license fee and royalty-free - no ongoing payments whether referable to commercial gain or otherwise;

• Worldwide - no territorial restrictions;

• Ongoing but revocable - continues indefinitely, but can be revoked at the copyright owner's discretion with written notification;

• Non-exclusive - we can grant the same rights to others; and

• Non-sub-licensable & non-assignable - you cannot grant or transfer your license rights to any other person.

 

The use of the image in the above described manner is strictly subject to the following conditions:

• The image must not be resold, re-licensed or redistributed without the express written permission of the photographer;

• The use of this image as a derivative work, and reselling or redistributing such derivative work (i.e. competition, print or art) is prohibited;

• The image must not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner;

• The image must not be incorporated into trademarks, logos, or service marks;

• The image must not be made available for download;

• The printing and sale of this image, as a whole or in part, is strictly prohibited;

• Each copy of the whole image must be attributed as follows: "(C) Steve Pole, used under license", unless otherwise agreed in writing.

 

There is no warranty, express or implied, with the purchase of this digital image file. The photographer will not be liable for any claims, or incidental, consequential or other damages arising out of this license or buyer's use of the image.
